9 Step-by-Step Process of Title Deed Transfer in Kenya.

Buying land is one of the most important investments you’ll ever make—and ensuring the title deed is legally transferred to your name is the final step that secures your ownership. Whether you’re a first-time buyer or guiding clients through the journey, knowing the process protects you from fraud, delays, and unnecessary costs.
Below is a simple, step-by-step guide to help you understand how title deed transfer works in Kenya:

1. Conduct an Official Land Search

Visit the Ministry of Lands (Ardhi House) or use the eCitizen portal to confirm:

  • Property ownership
  • Any encumbrances (loans, caveats, disputes)
  • Validity of the title

A land search costs KSh 500-1500

2. Obtain the Land Rates Clearance Certificate

For land within municipal areas, you must clear any outstanding land rates.
The seller obtains the certificate from the county government.

3. Land Rent Clearance (If Applicable)

For leasehold land, the seller must obtain a Land Rent Clearance Certificate from the Ministry of Lands.

4. Apply for Consent to Transfer

The seller applies for consent from:

  • Land Control Board (LCB) for agricultural land
  • County Land Management Board or relevant authority for urban plots

LCB consent fee is usually KSh 1,000.

5. Valuation of the Property

A government valuer assesses the property to determine stamp duty payable.
Valuation is done by the Ministry of Lands.

6. Pay Stamp Duty

Based on valuation:

  • 4% of the property value for urban areas
  • 2% for agricultural land

Payment is made through KRA’s iTax system.

7. Execution of Transfer Documents

The seller signs the transfer form, and the buyer signs acceptance.
Other documents required include:

  • Original title deed
  • Copies of ID & KRA PIN (buyer & seller)
  • Passport photos
  • Sale agreement
  • Consent to transfer
  • Valuation report

8. Lodging the Transfer at the Lands Office

All documents are submitted to the Ministry of Lands for registration.
The lands office:

  • Cancels seller’s name
  • Registers buyer’s name
  • Updates the land registry

9. Issuance of New Title Deed

After registration (usually 2–6 weeks, depending on county), the buyer receives the new title deed in their name.

Timeline

If everything is in order, the entire process takes about 30 to 90 days.
